CONTEST

OFFICIAL RULES AND REGULATIONS

1. The contest is (the “Contest”). “Entrant”, “Participant”, “you” and “your” shall all refer to the persons who enter the Contest (the “Entrant(s)”).
2. The Contest sponsor (the “Contest Sponsor”) is SUNNY D ENTERTAINMENT LTD.  (the “Company”).
3. No purchase is necessary to enter the Contest and the Contest is void where prohibited.
4. By entering the Contest, you automatically agree to accept and abide by these Official Rules and Regulations (the “Rules”) and by the Membership Agreement, Terms of Use and Privacy Policy. All decisions of the Contest Sponsor with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all Entrants in all matters as they relate to this Contest.
5. In order to be eligible, participants must be residents of Canada, excluding the Province of Quebec. The employees, representatives and agents of the Contest Sponsor and of the contest administrator and persons with whom they are domiciled may not enter the Contest.
6. To enter the Contest, visit www.ifheonlyknew.com, subscribe to the newsletter, and enter the contest as an Entrant. There is a limit of one (1) entry per person per email address.
7. Winning Entrants will be drawn randomly at the Company’s head office by an authorized representative of the Company. In order to win, you must respond the newsletter with the provided contest code.
8. Each winning Entrant will each receive 1 double movie pass from the Company. No winning Entrant may receive more than the specified prize.
9. The Contest Sponsor, will attempt to contact all winning Entrants by email within one (1) business day after each winning Entrant is determined and announced. In the event that any winning Entrant cannot be contacted within this time period or if a winning Entrant refuses the Prize, he or she will be disqualified, the prize withdrawn, and a second winning Entrant shall be drawn from remaining eligible Entrants.
10. All Prizes must be accepted as awarded. Contest Sponsor may also require winning Entrants to sign confirmations of eligibility and Releases respecting liability and publicity. Prizes may not be sold, transferred and are not convertible to cash. Contest Sponsor reserves the right to substitute any Prize in the event that the original Prize becomes unavailable.
11. Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsor, in its sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Contest Sponsor reserves the right to cancel, terminate, modify, amend, extend or suspend the Contest. Contest Sponsor reserves the right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsor reserves its right to seek remedies and damages to the fullest extent of the law. Contest Sponsor shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an Entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable.
12. Contest is subject to all applicable federal, provincial and municipal laws and regulations and is governed by the laws of the Province of British Columbia, Canada. By entering the Contest, Entrants consent to the manner of collection, use and disclosure of personal information for the purpose of administering the Contest and as set out in the Company’s Privacy Policy. 13. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of these Rules shall prevail, govern and control. In the event of any discrepancy or inconsistency between the English language version and the French language version of these Rules, as applicable, the English version shall prevail, govern and control.
14. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations that appear on the Company websites, including www.ifheonlyknew.com, are owned by the Contest Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
15. From time-to-time, the Company will publically display the winners’ first names, cities and countries to promote the Company generally as permitted under the Membership Agreement and Terms of Use set out at www.ifheonlyknew.com.
